As an attorney, Roe v Wade is an incorrect ruling not based on any portion of the constitution, independant of moral or medical issues. The Supreme Court made this ruling because state and federal legislaturefailed to legislate on the issue. Further, in our Federalist system, any power not sprcifically delegated to the federal government is reserved to the states. This is the specific point of judicial overreach by the US Supreme Court. Abortion has always been and remains in tbe purview of the states, but for the Roe v Wade decision. The highly emotional nature of both sides to this argument miss the mark of the correct legal forum is the state legislatures, or federal Constitutional ammendment.

The Preamble of the Constitution affords all of the rights and protections of the Constitution to the unborn with just 3 simple words, " and our Posterity ". Posterity if you're unaware, means future generations- the unborn. And the capitalized the P in Posterity, so you know they were pretty serious about it.
